Article 1: Parties This contract is concluded between the buyer (hereinafter referred to as "Buyer") and the seller (hereinafter referred to as "Seller"), who provides goods or services through the Turk Mall platform, which serves as a business-to-business (B2B) e-commerce marketplace (hereinafter referred to as "Platform"). By using the Platform, both parties agree to comply with the terms and conditions specified herein.

Article 2: Subject of the Contract This contract regulates the sale and delivery of the goods and services ordered by the Buyer through the Platform, including payment and return procedures. It applies only to transactions conducted via the Platform and is in accordance with the applicable laws and regulations related to distance sales.

Article 3: Product and Payment Details 3.1 Product Description and Quantity: The Buyer can view detailed information about the products or services offered by the Seller on the Platform, including price, specifications, and quantity.

3.2 Total Price and Payment: The total amount to be paid by the Buyer, including taxes, fees, and shipping charges, will be indicated on the payment screen before confirming the purchase. Payments are made using the payment methods offered on the Platform.

3.3 Payment Methods: The Buyer shall make payments via credit card, bank transfer, or any other payment method supported by the Platform. Payment shall be deemed complete upon successful receipt by the Seller.

Article 4: Delivery 4.1 Delivery Time and Place: The Seller shall dispatch the products within the estimated timeframe indicated on the Platform, after confirmation of payment. The Buyer must provide an accurate delivery address and contact information to ensure successful delivery.

4.2 Shipping Costs and Liability: The shipping costs will be paid by the Buyer unless otherwise agreed by both parties. The Seller shall be responsible for handing over the products to the shipping company, while the Buyer shall be responsible for paying any applicable customs duties and taxes.

4.3 Risk of Loss or Damage: The risk of loss or damage of the products passes to the Buyer upon delivery of the products to the carrier. The Buyer may choose to purchase shipping insurance to protect against potential losses.

Article 5: Buyer's Right of Withdrawal 5.1 Right of Withdrawal Period: The Buyer may cancel the purchase within 14 days from the date of receipt of the products, without giving any reason, by notifying the Seller via email or through the Platform.

5.2 Conditions of Withdrawal: The Buyer must return the product in its original condition, unused, and with all accessories included. The cost of returning the products shall be borne by the Buyer, unless the return is due to a defect or an incorrect product being delivered by the Seller.

Article 6: Refund and Return Conditions 6.1 Refund Process: Upon receipt of the returned product, the Seller will inspect it and, if the product meets the return conditions, initiate a refund within 14 business days. Refunds will be made via the original payment method used by the Buyer.

6.2 Non-Returnable Items: Customized, perishable, or damaged items due to improper use by the Buyer are not eligible for return or refund.

Article 7: Warranty and Defect Claims 7.1 Product Warranty: Products sold by the Seller may be covered by the manufacturer’s warranty. The warranty conditions and period will be stated in the product description on the Platform.

7.2 Defect Claims: If the Buyer identifies a manufacturing defect, the Buyer must notify the Seller within 14 days of receipt. The Seller will provide options for either a replacement or a full refund based on the conditions of the defect claim.

Article 8: Obligations of the Buyer and Seller 8.1 Seller's Obligations:

  • The Seller agrees to provide accurate product information on the Platform.
  • The Seller is responsible for packaging and dispatching the products as agreed.

8.2 Buyer's Obligations:

  • The Buyer must provide accurate personal and delivery information during the order process.
  • The Buyer shall pay the total amount specified during the purchase and fulfill customs duties if applicable.

Article 9: Dispute Resolution 9.1 Governing Law: This contract shall be governed by and construed in accordance with the laws of the country where the Seller operates.

9.2 Dispute Settlement: Any disputes arising from this contract shall be resolved through negotiation between the Buyer and Seller. If a settlement cannot be reached, disputes may be resolved by the relevant courts or arbitration institutions.

Article 10: Miscellaneous 10.1 Amendments: The Seller reserves the right to make changes to this contract, provided that such changes are communicated to the Buyer via the Platform. The Buyer is deemed to accept these changes unless an objection is raised within 7 days.

10.2 Communication: Any notices or communication required under this contract shall be made via email or through the Platform's messaging system.
